Terms & Conditions

Effective Date: January 1, 2022 · These Terms govern your use of electivecreditfinance.com (the "Site") and any renovation, installation, maintenance, or financing services provided by Home Glory Design ("ECF," "we," "us"). By using the Site or engaging our services, you agree to these Terms.

1. Definitions

• "Services" — all renovation, installation, maintenance, design, and financing-brokerage services offered by ECF, including those listed on the Site.
• "Agreement" — a signed written contract for Services, which incorporates these Terms and prevails over any conflicting verbal statement.
• "Site" — this website and its content.

2. Website Use

1. You must be at least 18 years old to submit forms or request Services.
2. You agree to provide accurate, current information and not to misuse the Site (including scraping, probing, or attempting to disrupt its operation).
3. Submitting a booking or contact form constitutes a request for Services — it is not a binding contract until a written Agreement is signed by both parties.
4. All Site content (text, imagery, layout, logos) is the property of ECF or its licensors and may not be reproduced commercially without written permission.

3. Quotes, Pricing & Payment

1. Quotes are free, itemized, fixed-price for the defined scope, and valid for 60 days unless stated otherwise.
2. Prices shown on the Site ("starting at" figures) are indicative minimums for typical scopes; your final price depends on site conditions, materials, and selected options, and will be confirmed in your written quote.
3. Payment schedules (e.g., deposit / milestone / completion) are defined in your Agreement. Work may be paused if scheduled payments are overdue by more than 10 days after written notice.
4. Late balances may accrue the lesser of 1.5% per month or the maximum rate permitted by applicable state law.

4. Financing Terms

1. Renovation financing is offered subject to credit approval. Soft-check pre-approvals do not affect your credit score; formal applications may involve a hard inquiry with your consent.
2. Advertised rates (e.g., "from 6.99% APR") depend on creditworthiness, term, and amount; your actual rate is disclosed before you accept any loan.
3. Loan documents are governed by the federal Truth in Lending Act and applicable state lending laws; those documents control in any conflict with these Terms.
4. You may prepay in whole or part at any time without penalty.

5. Scope of Work & Customer Responsibilities

1. ECF will perform Services in a workmanlike manner consistent with the approved design, applicable building codes, and manufacturer specifications.
2. You agree to provide safe site access, working utilities, and a clear work area; to secure pets; and to promptly review and approve selections so schedules can be met.
3. Changes to scope must be requested in writing and are performed only under a signed change order stating any price and schedule impact.
4. Hidden conditions (concealed structural defects, hazardous materials such as asbestos or lead in pre-1978 homes, code violations) may require additional remediation. ECF will document findings, and required abatement work by licensed specialists may be quoted separately.

6. Permits, Codes & Insurance

Unless your Agreement states otherwise, ECF obtains required building permits and coordinates municipal inspections. ECF maintains general liability and workers' compensation insurance; certificates are available on request. Homeowner-installed or homeowner-supplied items are installed "as-directed" and carry warranty on labor only.

7. Schedules & Delays

Target timelines are stated in your Agreement. ECF is not liable for delays caused by weather, utility outages, permit authorities, supply-chain disruptions, hidden conditions, or customer-caused changes. Where a delay beyond our control exceeds 15 business days, we will propose a revised schedule in writing.

8. Workmanship Warranty

1. ECF provides a written workmanship warranty of 2 years (Essential), 5 years (Signature), or 10 years (Estate Transformation / as stated in your Agreement), beginning at final walkthrough.
2. The warranty covers defects in our labor and installation. Manufacturer warranties on materials and appliances apply per their terms; we register them on your behalf where possible.
3. The warranty is void for damage from misuse, neglect, unauthorized alterations, ordinary wear and tear, or force-majeure events, and does not cover third-party work on the same elements.
4. To make a claim, contact us at (931) 858-6881 or info@homeglorydesign.com. We will inspect and repair covered defects at no cost within a commercially reasonable time.

9. Cancellations

1. You may cancel a signed Agreement within any cooling-off period required by the Federal Trade Commission's Cooling-Off Rule or your state's law.
2. After that period, cancellation requires written notice; you are responsible for work performed, materials specially ordered, permit fees, and a restocking/administrative charge as set out in your Agreement.
3. Financed projects follow the cancellation and rescission terms of the loan documents.

10. Disclaimers

Site content is provided "as is" for general information. Renderings, lifestyle imagery, and "starting at" prices are illustrative and not a guarantee of final results or pricing for your property. To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose with respect to Site content (not Services — those carry the express warranty in Section 8).

11. Limitation of Liability

To the fullest extent permitted by law, ECF's total liability arising from Services is limited to the amounts paid by you under the applicable Agreement. ECF is not liable for indirect, incidental, consequential, or punitive damages (including loss of use or rental value) except where such limitation is prohibited by law. Nothing in these Terms limits liability for negligence that causes personal injury, or any other liability that cannot lawfully be limited.

12. Dispute Resolution & Governing Law

1. These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules.
2. The parties agree to attempt good-faith resolution for 30 days before commencing formal action; construction disputes may be subject to mediation where required by state law.
3. Any formal action shall be brought in the state or federal courts located in Posey County, Indiana, unless applicable law provides otherwise.

13. Indemnification

You agree to indemnify ECF against claims arising from your breach of these Terms, your misuse of the Site, or work you (or contractors you hire directly) perform on the same project elements, except to the extent caused by ECF's negligence or willful misconduct.

14. Force Majeure

Neither party is liable for failure to perform due to events beyond reasonable control — including natural disasters, epidemics, war, labor disputes, or governmental actions — provided the affected party notifies the other and resumes performance promptly when able.

15. Communication Consent

By submitting forms on the Site, you consent to receive calls, texts, and emails from ECF regarding your enquiry at the contacts provided (standard message rates may apply). Marketing communications are optional and stop immediately upon unsubscribe at unsubscribe.html.

16. Entire Agreement & Changes

These Terms, together with your signed Agreement, form the entire agreement between the parties regarding Services. ECF may update these Terms for the Site at any time by posting a revised version with an updated effective date. Signed project Agreements are amended only in writing.
